<p style="text-align: justify;">The first ever European arrest of a rogue developer selling properties on the Turkish Republic Northern Cyprus has been issued and the accused arrested.</p>
<p style="text-align: justify;">UK national Mr Gary Robb is a convicted drug dealer. He escaped a prison sentence by fleeing to the north of Cyprus where he preceded in passing himself off as a developer and illegally selling many Greek Cypriot owned properties without title deeds of course, and also went on to sell properties on a large development which he then failed to complete and left the island. Leaving many people with unfinished properties and of course once again no title deeds.</p>
<p style="text-align: justify;">However, he returned to the north after making a deal with the authorities and was later arrested by the police in the north and sent back to Cleveland the original place of where he had fled from the drug charges.</p>
<p style="text-align: justify;">Under a new law that prohibits the illegal selling of Greek Cypriot owned properties on Northern Cyprus, once the European arrest warrant was granted the Cypriot police flew to England and the UK police handed him over as he had just finished serving a drug sentence. No luck for the wicked!</p>
<p style="text-align: justify;">Mr Robb will now be interrogated and his case sent to the attorney general.</p>
<p style="text-align: justify;">Well we could say better late then never for the new law to come into action but it’s like everything else in this Mediterranean island many people must suffer before anything is ever done!</p>
<p style="text-align: justify;">These individuals who knowingly sell Cypriot owned property in the north are nothing more than con men and deserve to go to prison. They have purposely used the political situation to gain money and hurt a lot of people along the way and deserve to go to prison.</p>
<p style="text-align: justify;">There are many developers who have done what Me Robb has done and we for one are happy that this new law has been implemented.</p>

<p>We have to say we are quite envious of the area of Limassol coming from the East Coast ourselves.</p>
<p>Limassol appears to be claiming all the new and valuable development needed to bump up the tourism and property market. Works are already underway for a new luxury marina and an upgrade of the existing port which will bring in thousands of marina lifestyle and yachting fanatics holidaying and investing.</p>
<p>We have all heard how the Russians are going to take our island by storm this year and future years to come and Limassol may well and truly be the lucky recipients of this market also, with a brand new Russian Orthodox Church planned to be built by the end of the year.</p>
<p>This will be the biggest and main Russian Orthodox Church on the island attracting the Russian market to the area.</p>
<p>Limassol actually does accommodate for the Russian nationals on a whole having Russian speaking schools and places of worship already in practice.</p>
<p>This was an excellent step foreseen or not, due to the throngs of Russians on their way to Cyprus in the near future.</p>
<p>The Church will be named &#8216;St Nicholas Church&#8217; and will cost in the region of five million euros.   This is hoped to be funded by way of donations from the public.</p>
<p>A very affluent Russian business man has already pledged he will donate half a million euros to the place of Russian worship.</p>
<p>Title deeds to the land have already been transferred and plans of the church have been blessed so all is set to go.  The design will boast traditional Russian style and may take a few years to complete.</p>
<p>This is excellent news for Limassol and the Russian Nationals.  They will definitely feel more than welcomed.</p>
<p>We should also on the East Coast start to look at accommodating the trend in foreign nationals to help our areas survive and benefit from the international markets.  Offering foreign education and places of worship are a must in today&#8217;s society.  The Greek Cypriots alone can not keep this island up and running.</p>

<p><strong>Cyprus Property lawyers &#8211; review &#8211; Cyprus Title Deed Reform Delays</strong></p>
<p>After all the controversy over the title deed issues, and the urgency in devising the 5 new legislations to form a new title deed procedure, we are still no closer to a solution.</p>
<p>We have to however, respect the efforts of Mr Syliotis Cyprus Interior Minister as his efforts towards this issue have been outstanding.  It may have been along time coming but since the controversy broke out Mr Syliotis really has tired his best to have this matter resolved as quickly as possible.</p>
<p>Mr Syliotis recently slammed the house of parliament claiming MPs were delaying the legislation. We for one are outraged that further delays are evident.  Why would MPs want to delay this strategy from coming into effect as soon as possible? What possible valid reason is there for not wanting to put public outrage to rest?</p>
<p>Last year we were waiting in anticipation for the 5 legislations to be passed then to be told there was a delay due to imperfections in the bills and discussions would resume after the summer break in September.</p>
<p>We are now in April 2011 and low and behold we are once again being told 2 of the 5 bills are still not ready.</p>
<p>&nbsp;</p>
<p>This is very hard to conceive. The new reform will not only help many thousands of homeowners, clear the back log of deposited application and issue thousands of title deeds, but it will also bring in hundreds of thousands of euros each year helping the Cyprus economy.</p>
<p>We are asking the MPs outright what is the reasoning behind this we would like to know?</p>
<p>We would like to thank Mr Syliotis for his efforts. We feel he is the only politician who really tries to do something!  We support him and we will continue the fight for Cyprus Title Deed Reform until public justice prevails.</p>

<p><strong>Property Lawyers in Cyprus</strong> – Review – Turkish Protests</p>
<p>Turkish Cypriots took to the streets again in a friendly protest but with anger in their hearts.</p>
<p>This was a planned protest to show Turkey and their Turkish Cypriot leader that they no longer want to be under Turkeys thumb, they no longer want to have to abide by Turkeys rules and they no longer want to live oppressed.</p>
<p>Turkey has imposed some unwanted budget cuts forcing over thirty thousand Turkish Cypriots to pull together and make a stand.</p>
<p>The measures forced on the Turkish Cypriots include Turkish government salary reductions, taxing pensions and reducing the non-taxable income limit by 7%.</p>
<p>These measures were agreed upon by the Turkish Cypriot leader and it is said that these cuts must be imposed otherwise the TRNC could face bankruptcy by the end of the year.</p>
<p>The Turkish Cypriots are also angry the government is not standing up to Turkey and agrees with all rules and regulations they impose!</p>
<p>The Turkish Cypriots do not want to be ruled anymore they want their lives back, they want to be independent and they also want a people’s government that is going to look out for its people.</p>
<p>These issues are a reoccurring story in several other countries at the moment and while the protests are friendly they are getting bigger and bigger and more and more Turkish Cypriots are jumping on board.</p>
<p>The Republic  of Cyprus are still being blamed for these outbursts, albeit having whatsoever to do with these issues.</p>
<p>This is something that Turkey have done themselves and if Tunisia, Egypt, and Libya are anything to go by Turkish Cypriot Erdogan should really be looking at what his people are saying.</p>
<p>So what does this mean for Cyprus on a whole and how will this affect the Cyprus Political problem?</p>

<p>Property Lawyers in Cyprus – Review – Cyprus Title Deeds</p>
<p>In a bid to try and combat the islands Town Planning and Title Deed issues a brand new Town Planning and Housing department is due for total restructure and development.</p>
<p>The actual new Town Planning and Housing main office in Nicosia will be a new development constructed to a very high modern standard and is said to be completed by the latter part of 2012.</p>
<p>The restructure of the Town Planning departments will see all departments throughout the island work with one main frame computer system.</p>
<p>This will help communication issues between the islands offices and quicken the procedures. It will avoid issues such as lost paperwork and communication error and delays between local and main offices just for example. Which are the most common problems and sometimes unavoidable when many offices are not working within the same main frame.</p>
<p>Complete and overall synchronization of the offices was top of the list to help combat Title Deed application issues and it is the only way to work in this era and should have been dealt with many years previous. Now you can go to any office in any part of the country and find out the status of your application or for any relevant information.</p>
<p>The Town and Planning website has also updated its website so that any individual can view the status of the Title Deed application. For this service visit <a href="http://www.moi.gov.cy/">www.moi.gov.cy</a></p>
<p>These are excellent steps forward for property purchasers, on the other hand there is still along way to go but at least some progression is evident!</p>
<p>The amendments to 5 bills created to initiate the Title Deed Reform are also now being addressed in parliament which saw previous delays due to the lack of preparation of the bills and certain disagreements between all parties.</p>
<p>The Town and Planning department are now committed to dealing with and finalizing Title Deed application within a one month period.</p>
<p>&nbsp;</p>
<p>Finally progression is evident, it may not be immediate but it does look clearer for the future and more effort is being made. We really hope the government pulls their finger out now. As we said 2012 and 2013 are going to be the turn around years for Cyprus and we truly believe the island will revive itself so the government can not let us down.</p>

<p>Investment opportunities in Iraq are endless as there is nothing left in the country.  Therefore, residential and commercial investment is desperately needed from world-wide investors.</p>
<p>Iraqi Nationals are living in derelict houses and poverty what more can we say! The need for residential housing and commercial and industrial investment is very high.  Grants are being given to the Iraqis for housing and more jobs are becoming available. But a whole new country starting from scratch is what we are looking at here.</p>
<p>It could be said that these investors are making money from the very sad devastation and death these people have experienced for so long.  However, for the remaining nationals it is very important to recuperate there economy, bring in foreign investment and rebuild there country and help them build a brand new life, and to be fair after all this time they deserve this!</p>
<p>Each of the 18 states in Iraq are preparing lists for future projects of which world wide investors will be welcomed to put forward there tenders.</p>
<p>We really wish the best for the Iraqi Nationals, they more than deserve a new life and we are going to hear many good and positive things about this country for a long time to come.</p>

<p>At long last the Cyprus Government are taking the high price of living here in sunny Cyprus seriously, and sent a warning to all retailers to keep their prices down, otherwise investigations in to their business will be conducted&#8230;.and we are sure this is an action that many shop keepers would like to avoid.</p>
<p>For many months we have been reporting how high the cost of living is here in Cyprus compared to other EU states.  What you can buy in Cyprus for the Euro is dramatically less than what you can buy in say Spain just for one example.</p>
<p>These warnings we feel should have come a long time ago, at least when the Euro replaced the Cypriot pound.  And with one of the worst recessions in history to hit our island these warnings and investigations should have been present throughout, but better late than never we could say!</p>
<p>Everyone must play their part in the Cyprus economic recovery and retailers are definitely of no exception.</p>
<p>The blame for some of the rises have been put on the fact that the minimum wage has recently increased, therefore rises are evident to cover the cost of staff wages, but if the truth be told, the cost of living has been rather high for some time now, in fact quite some time before the rise in minimum wage, and therefore profits have been happily made, but the time has come to stop the high level of profiteering as if continued our island will be sent to rack and ruin.</p>
<p>The high cost of living has been a very frustrating issue and has made us very disappointed that the business sector has not before now reduced or capped prices to keep the tourism trade coming to our island.</p>
<p>We are very happy though that the government are taking steps to combat this issue and we hope they keep their word and force this in to action.</p>
<p>After so much negative press the Cyprus Government appear to actually be listening to what the public are saying and what the island really needs and we hope and pray that this will be reiterated in other areas that also need correction.</p>

<p><strong>Cyprus Property Lawyers</strong> - As we have predicted the 2011 Cyprus Economy appears to be looking quite promising and this seems to be the general consensus as well as the Cyprus Governments also.</p>
<p>Making promising progress we believe, towards helping the Cyprus economy, the countries spending and the high deficit issue, the Cyprus Minister of Finance has been reviewing the matter of reducing the salaries of various high positioned members of government, which will also include the Ministers themselves. The Cyprus government staff not only receives high salaries but include all the added benefits as well and it reaches to quite a tidy sum.</p>
<p>However, though some union heads are optimistic about the future of the Cypriot economy, others are not so happy at the way the Finance Minister has addressed the issue regarding reducing government wages.</p>
<p>Representing state officials PASYPI Union, were absent from a meeting called on by the Minister to discuss the Cyprus economy and financial plans for the next year, stating reasons for this is that the Minister has shown lack of regard for the Union by discussing the reduction of Government staff allowances without the Union being present at the discussions.</p>
<p>It is widely thought that any attempt to reduce government wages could result in members of the Government going on strike.</p>
<p>While putting a smile on our faces that the Finance Minister is seriously looking at reducing the high level at which the these officials are getting paid, it also makes us feel angry that the lower paid workers who maybe do not even take home 600-800 euros a month are fighting for their wages to be increased by 5-10 euros a month and they could probably do a better job than the government are doing of running our country right now.</p>
<p>The wide spread views in Cyprus that the rich stay rich and the poor stay poor, may not necessarily be true for much longer if the governments are serious about such cuts. And it will not stop there. Putting government officials aside, many of the rich and affluent society in Cyprus could very well be taking money out of there pockets also in helping the recovery of the Cyprus economic state, as yet to be decided by the Cyprus Finance Minister and members of the cabinet.</p>

<p>Paphos has had a rickety time through the recent recession with property sales down and emigrants leaving to go back to their own countries. And what a shame that is, as those individuals will now miss out on the biggest development in Paphos, alongside the new airport, with a new 1000 berth Marina will to be built.</p>
<p>The size of the Marina will be approximately the same size as the new Marinas being built in Larnaca and Limassol.</p>
<p>It has been reported that Leptos Estate will head the group of private companies investing in the Marina and at 70 Million Euros will be injected into the project.</p>
<p>Conditions for the tender being awarded to Leptos Estates, was that the Marina had to be built within a 3 year period. So it really looks like all the Marinas Island wide will be completed around the same time frame.</p>
<p>Paphos is a beautiful area of Cyprus and the new Marina will compliment this side of the island even further, and news of all the Marinas has actually already favoured property prices in surrounding areas.  Businesses are also staring to look up and see some hope.</p>
<p>While plans for the new Paphos Marina are not so defined as yet, news reports show there will be leisure facilities, bars and restaurants and the scope for residential property.</p>
<p>This is great news for Paphos and all Paphos residents who will definitely reap the rewards.  However, once again there has been news reports that delays are ahead of us and this is an issue the Cyprus Government should avoid.</p>
<p>The whole marina development in Cyprus is set to change the face of our island and make Cyprus one of the busiest and most thriving sailing and yachting country in the EU.</p>
<p>We cannot wait for our coastal towns to be buzzing with the yachting fanatics and business booming once again.</p>

<p>The Limassol Marina, one out of four new Marinas being developed in Cyprus, will be completed by 2012 with works already underway.</p>
<p>At this stage, the Marina will house up to 1000 boating vessels and consist of up to 300 new luxury residential properties with the availability to have a yacht parked at the end of the garden.  How extravagant is that?</p>
<p>Initially, included in the Marina surroundings will be shops, bars, restaurants, traditional Cyprus taverns, swimming pool, gym and spa with further features such as a cultural and conferencing centre and a green park will compliment this development .</p>
<p>As in all the new Marinas being developed on our magical island, the amenities will be top notch and facilities will be available for all yachting needs.</p>
<p>Billions of Euros are being put into these Marinas and property prices in the surrounding areas have already been reported to have tripled.</p>
<p>Limassol is renowned for its cultural in keeping, along with its many off shore companies and shipping trade, offering easy access to other Middle Eastern and EU states.  The new Marina will enhance this.  It is reported that out of all the Marinas this is set to be the most impressive with many features being added.</p>
<p>The current Limassol port is already the largest on the island and with the newly devised expansion of the old and the new marina and accommodating features, it appears Limassol residents are in for a spectacular treat.</p>
<p>What a time for Cyprus.  In all of the Cyprus history there has never been so much development and progression all at one time, new airports, new golf courses and amazingly new marinas and all while keeping in with natural heritage and culture.</p>

<p>There are mixed reports about today’s <a href="http://www.lawcyprus.org/">Cyprus Property</a> Market.</p>
<p>The banks appear to believe that interest in the Cyprus Property Market is still very low.  House prices are falling, which is believed to be due to lack of demand for Cyprus property.  And of course the banks view this as a very big risk to them and further decreases could cause major problems.</p>
<p>However, the banks themselves are causing a very big problem as they are not budging on their interest rates.  While other European countries are dropping their interest rates to help their property markets, Cyprus interest rates are still at an all time high.</p>
<p>This issue must be addressed with the government , the Central Bank of Cyprus and the EU Central Bank before our property market comes to a complete halt.</p>
<p>If overseas investors, who still hold a high percentage of property sales in Cyprus, become aware of other EU states offering a much lower interest rate, we can sadly but surely kiss goodbye to the overseas investor and say hello to a long cold road to economic recovery.</p>
<p>Yet on the contrary, the government reports that contracts deposited at the land registry have increased by up to 25% on last years sales.  And around 22% of these contracts are from overseas investors. Famagusta, Limassol and Nicosia are seeing major increases in sales with Larnaca and Paphos steadily trailing behind.</p>
<p>It is very hard to say for sure the overall outcome will be for Cyprus.  Practicing as Property lawyers in the Paralimni area of Cyprus, we can honestly say we have definitely seen a major rise in business compared to last year. Our office is in fact opening another office in Larnaca to deal with the extra workload. So from that point of view we believe Cyprus is definitely on the mend.</p>
<p>We also believe this is due to a lot of development taking place in Cyprus and more and more people are becoming aware of this.</p>
<p>The banks must address the interest rate and mortgage facilities issue, so not to spoil it for the rest of Cyprus and to help the economy.</p>
<p>On a whole, we know some issues need to be addressed and corrected but we are happy with the economic progression. We really believe Cyprus is on the up and up.</p>

<p>Buying a property is a dream come true for many! It can also turn in to your biggest nightmare should you not follow the correct procedure.</p>
<p>Some developers and agents have a knack for charming potential investors, especially those who are new to the overseas property markets. Which is why, we are publishing this article in the hope that many investors who are interested in investing in our beautiful island  of Cyprus will read this and keep it firmly in mind.</p>
<p><strong>The most important aspect when buying any property is the Contract of Sale.</strong></p>
<p>The contract of sale is a legally binding document that states the prices, procedures, agreements and expected requirements to be under taken by the vendor and purchaser when buying a property.</p>
<p>A purchaser must appoint an independent solicitor to</p>
<ul>
<li>Conduct a search on the land/development &#8211; to make sure there are no loans used against the potential investment by the developer.</li>
<li>Prepare a Contract of Sale- protecting the rights of the purchaser and go through every detail with the purchaser to make sure they are happy and secure in their purchase. The solicitors’ job is to make sure the contract of sale protects you against any breaches that may occur from the developer and does not favour the developer in any way.</li>
<li>Guide you through every step of the procedure according to the contract of sale until delivery of the property has taken place.</li>
</ul>
<p>If you should not appoint a solicitor and you sign a contract that has been prepared by the developer or agent, this can have disastrous results.   You may find the contract of sale does not protect your rights but the developers’ rights, in which you could lose your life savings or end up with an unfinished property or a totally different property than to the one you thought you had purchased.</p>
<p>This is the law in Cyprus and if you sign a contract of sale not prepared and checked by a solicitor, it may be deemed you do not have a leg to stand on should any breaches occur. It is very important for the solicitor to conduct all necessary due diligence with regards to your purchase.</p>
<p>We plead to all potential investors, to let a solicitor do all the work for you in accordance with the Cyprus law this is your only means of protection. What seems like a perfect agreement may be your worse ever nightmare.</p>
<p>For your own safety be protected and appoint an independent Cyprus lawyer for your dream property purchase.</p>

<p>After our previous articles on the new Cyprus Title Deed Reform and anticipation of the new legislation to be passed in parliament, we regret to inform you that there has been a delay and the legislation has not yet been passed.</p>
<p>If you are an A&amp;G Kouzali website fan, you will be very aware of how much our Cyprus Lawyers, Mr Kouzalis in particular, has made great efforts in the fight for a new Title Deed procedure. And our fight is now far from over.</p>
<p>We are very disappointed that the legislation has been delayed, even so, that we have written a letter to the Cyprus Minister stating our concerns and requesting a speedy result. We are also writing to each Member of Parliament and requesting that the legislation be passed without any delay.</p>
<p>We urge the public to do exactly the same thing! If we all pull together and put further pressure on the government and the members of Parliament, a result must prevail.</p>
<p>We have continually joined in the fight for a new Title Deed procedure in Cyprus and we obligatory report all latest news via our website and now we must work even harder and do our utmost to make sure that citizens both local and international are not let down after such promises were made.</p>
<p>We have been supportive of the Minister efforts and had complete faith in the new legislation, but now it is time to get up and fight again as this is unacceptable.</p>

<p><strong>2010 is said to be the year for Property Auctions?</strong></p>
<p>Buyers and sellers want to cut out the agents and get their properties sold quickly, and brought at cheap prices.</p>
<p>This saves the developers a lot of time as many properties can be sold at once. Banks are also using Property Auctions to sell off distressed properties acquired through the financial downturn.</p>
<p>Property Auctions were previously back of the queue in terms of property sales, but with the changing times, quick and cheap sales are must.</p>
<p>Property Auctions are taking place in countries such as Dubai, Spain, Portugal, Greece, USA, and here in Cyprus.  It is expected that Property Auctions will grow very popular and will soon take place all over the world. With foreign interests upping auction sales, agents may very well become a thing of the past.</p>
<p>We feel practising as International Property lawyers in Cyprus, that Property Auctions are a good idea for investors to obtain a bargain property.</p>

<p>After our previous review on the issue of eco-tourism and property, it appears eco-friendly is making rapid progression in Cyprus, with new EU Laws being passed to regulate and implement specific changes.  Practising as Property Lawyers in Paralimni Cyprus and being such a highly distinguishable company within our community, we are obliged to follow all issues of Property Law, Property Markets and growing trends.</p>
<p>Eco-friendly is not just a trend anymore, it is a must.  The EU Parliament and Council have made preliminary agreements that all newly built properties must not only be built with energy saving materials and products, but must also be powered with a renewable energy system.   Zero energy consumption is needed and criteria to this effect will be implemented and obligatory for all new developments.</p>
<p>By the year 2020 all EU states must be in line with strict regulations and all developments must be achieving a high standard of energy saving through renewable functioning.  Set regulations are yet to be agreed upon for the renovation of existing houses but this is surely soon to follow.</p>
<p>This decision has come before the Copenhagen Summit on climate change and this decision by the EU Parliament could positively influence and help achieve the goals that officials attending the Copenhagen Summit are striving for. </p>

<p><a href="http://www.lawcyprus.org/">CYPRUS PROPERTY LAWYERS</a> ANALYZE NO SMOKING BAN</p>
<p>Although we at A&amp;G Kouzali Legal Firm in Cyprus are in favour of the NO SMOKING BAN, we still have to review all issues to this controversial subject.  </p>
<p>Tensions are rising as Cyprus now abides by the no smoking ban, of which has actually already been introduced in Cyprus but has never officially been forced. However, that has now changed as from 1st of January 2010 if anyone is caught smoking in an enclosed public place, they  will be fined up to €2,000.</p>
<p>The no smoking ban was planned to commence at midnight on New Years Eve, but later became conscious to authorities that this could quite possibly cause major rebellion for smokers whilst under the influence of alcohol celebrating the new year and therefore came in to affect on news years day.</p>
<p>Cypriots are commonly known for social smoking and it has always been allowed in places of business and pleasure, it has never really been judged as a prejudicial issue, more of a social habit and therefore this is not a concept that Cypriot Nationals are in favour of.</p>
<p>A no smoking ban, although you would not believe, can actually have a negative affect on the economy. For example the no smoking ban in England has physically changed the face of night time activity. Bars and clubs are no longer busy because individuals like to smoke while consuming alcohol.  While day time life proceeds as normal night time life is diminishing.</p>
<p>Many of our seaside towns gain major revenue from the island nightlife.  Agia Napa for example situated in the Famagusta region of Cyprus consists of many bars and clubs accommodating the younger visitors to the island, this is one of the main revenues in the tourist season.  After review, we found many individuals would rather not go out and drink if they can not smoke.  </p>
<p>Therefore, what will happen to the business owner who relies on the night time tourist trade and is this really a good time when Cyprus is already trying to revive its economy? We will endeavour to answer these questions in the New Year when this ban comes into effect.</p>

<p>While the Property Market in Cyprus is functioning at such a slow pace, developers are trying different schemes in order to prevent the market from coming to a standstill.  Our job as International Property Lawyers in Cyprus is to keep a look out for new concepts and how they work legally.  One scheme in particular that caught our eye was the home swap scheme.</p>
<p> After review, we found that this scheme is still in the early stages, but looks to be an effective way for developers to sell their high supply of unsold properties.  The Home Swap Scheme initially targeted at the UK property buyers, offers them the chance to exchange their UK home for a Cyprus home of approximately the same price range.  Their other option is to part exchange their UK home and take out a mortgage for the remainder of the asking price.</p>
<p>This is a great opportunity for those who want to move to Cyprus but cannot sell their UK property due to the current depleted market.  The developer will keep the UK property and use it as a rental income until the UK Property Market is on the up and then sell it to make their profit. </p>
<p>In the long run this appears to be a good investment for the developer.  And it is less hassle for the UK buyers having to go through the rigmarole of selling their property.  As in all new schemes and projects there are always hiccups, so we will continue to follow this new adventure and update you on any future progression.</p>

<p>We honour the truth in all aspects of work and life and therefore, all members of A&amp; G Kouzali Property Lawyers in Paralimni Cyprus would like to take this opportunity to apologise in advance for any inconvenience caused to our clients.  At the same time we promise you that we are learning from our mistakes.</p>
<p>We can truthfully admit that because of increased volume in workload our office could not always cope.  We are very pleased our workload has increased but we are sad to say our income has halved due to the global struggle. And although we have not had to terminate any staff contracts, the economic crisis saw to it that we could not employ additional staff to deal with this problem.  </p>
<p>Our business has increased dramatically and certain mistakes have been made and therefore, after extensive review of our actions during the course of 2009, we have learned where we went wrong and how to rectify these issues in order to offer a flawless service.</p>
<p>Being a company that can accept constructive criticism we have decided to create a new section on our website for people to put forward theirs views and criticisms in order for us to discuss this with our clients and further learn from our mistakes.</p>

<p>We have been practicing as International Property Lawyers in Cyprus for  many years.  As part of our job we have to constantly review the Global Property Market.  Naturally, being of Greek/Cypriot origins we pay special attention to Greece. </p>
<p>Diversification has been a priority in keeping the Global Property Markets alive and Greece has been no exception.  Although Greece is taking every step possible to establish itself as a major player in the property and tourist industry, it has still suffered the same as the rest of us.</p>
<p>Fractional Ownership has been present in Greece for some time, but did not really appeal to the property market.  This could be due to the lack of marketing and education or the notion of buying property with people they do not know.  However, since the global financial downturn it has become increasingly more popular.</p>
<p>It can be said worldwide, that people want to invest in property but have held back due to nervousness and apprehension of spending money.   Fractional Ownership emerged to be the best possible solution to this problem, and as in several other countries it has proved to be the current growing trend in Greece.</p>
<p>The law in Greece allows any number of purchasers to invest in one property, awarding each investor an equal share and documented on the sale of contract.  So for an example on the island of Crete this concept easily allows for purchasers to buy into one property with relatives, friends and acquaintances and not having to share with strangers. This also saves on money relating to the running costs and agents commission.</p>
<p>Due to the progression of major development in Greece now is a perfect time to invest. It is predicted that Greece is the up and coming place to be.</p>

<p>As part of our client protection awareness articles, we would like to advise you on a matter that unfortunately happened to one of our clients.  We hope by publishing this article we can avoid it happening to anyone else in the future.</p>
<p>One of clients who had existing debt in the UK, proceeded to purchase a second holiday home here in Famagusta.  Due to their unfortunate financial situation they got to the point of maybe having to sell their UK property.</p>
<p>Our office ran a due diligence on the Cyprus property and later found out that our clients had land registered the contract in January 2006. However, it later came to our attention that in March 2007 the developer had used the property for collateral at the bank for the amount of €170,000.</p>
<p>Therefore, in order to sell the property a waiver had to be obtained.  The bank initially would not grant a waiver and we proceed in sending numerous letters to the central bank and to the British High Commission.</p>
<p>Finally after a few months had passed the bank granted us a waiver but the wording was not satisfactory.  The waiver deemed to be in the interest of the bank and not of the purchaser.</p>
<p>In the end the purchasers cancelled their contract and this in turn, left them in further and more major debt.</p>
<p>The moral to this story is to always perform due diligence on a positional property investment. The bank lost clients and the clients nearly lost their UK home.</p>

<p><a href="http://www.lawcyprus.org/">CYPRUS PROPERTY</a> LAWYERS STUDY THE ORAMS CASE</p>
<p>The Orams case has been the talk of all Greek Cypriot nationals of late.  Our Property Lawyers based in Paralimni Cyprus, have particular interest in this case and continually study any developments.</p>
<p> The case originally started in 2005 when Mr &amp; Mrs Oram received instructions to appear in a Nicosia Court regarding their property situated in Lapithos on the Turkish Occupied Northern side of Cyprus.  Before the Turkish invasion in 1974 the said property was owned by the Apostolides family and after the divide was sold by a Turkish Cypriot to UK nationals Mr &amp; Mrs Oram, who proceeded to rebuild a house on the land.</p>
<p>The summons ordered the Orams to appear in the Nicosia court to converse on the matter of allegations of infringement regarding the Apostolides family home.  The Orams did not respond at first, feeling safe in their knowledge that they had brought the property fair and square and so were protected.  However, this proved to be quite the opposite when they later attended the Nicosia court and were ordered to tear down their house and give back the land to the Apostolides family along with further corrective compensation.</p>
<p>The Orams continued to ignore this pressing issue and believed that as they were north of the Island no court could possibly have Jurisdiction and therefore, no decision could be upheld. The Apostolides family, very determined of their rights proceeded to have this judgement solidified in the UK London court of Appeal.</p>
<p>The UK court initially denied the case stating they had no jurisdiction on this matter, but then decided to request advice from the European Court of Justice as to whether the UK court had any authority to make rulings on cases involved within the Turkish Occupied Northern part of Cyprus, as this state is not recognized as an official sate by any country but Turkey.  The European Court of Justice returned their conclusion as any court who is a member of the European Union can officially rule on legal issues regarding the Occupied Northern side of Cyprus.</p>
<p>The case is still pending in the London Court of Appeal and we will endeavour to keep you up to date on this matter. We are supporting all Greek Nationals in making claims for their property in the Northern area of Cyprus.</p>

<p>After we analyzed the effects of the Euro against the Sterling Pound we found that English citizens are now accepting the low rate offered. It is becoming the norm these days and now that it is widely accepted there seems to be a rise in property and business transactions.</p>
<p>The exchange rate for Euro to Sterling Pound on average is pound for pound. Yet some countries like Spain for example take the low rate in to consideration and reduce prices accordingly, offering major discounts.</p>
<p>Non EU countries who offer strong rates against the currency are seeing a major rise in interest from European buyers. Countries such as the USA and South Africa for example have many Europeans buying property and holidaying at the moment.</p>
<p>Cyprus is reported to still be quite expensive compared to other European countries in relation to what you can buy for Euro currency and maybe could take a leaf out of their books and start introducing some reductions on relevant products.</p>
<p>In saying that Cyprus has many qualities that other EU Countries can not offer, such as safety and excellent tax regimes being a just a couple to mention.</p>
<p>If we did offer reductions to override the Euro rate, Cyprus would be the perfect paradise for all.</p>

<p>Brazil has been receiving fantastic reviews confirming the Brazilian market on the whole is doing amazingly well.  A recent project consisting of 104 new properties, situated in the Sao Paulo region was reported to have been sold out within a few hours.  The developers are advising that there is higher demand for Brazilian property than there is a supply.  This is great news in this time of struggle.  </p>
<p>To help the construction industry the Government has provided R$ 60 Billion. This is part of a motivation package towards supplying more affordable housing for the lower – mid income purchasers.  Other incentives included in the package to revive the Brazilian Property market are, reductions on property tax from up to 6%,  subsidies to cover costs for purchasers of a certain criteria and a restructured easier process for required licences relating to new developments.</p>
<p>Many overseas investors are buying Property in Brazil at an accelerated rate, giving rise to Brazil being one of the most popular places to invest at this uncertain time of financial worry.</p>

<p>We are sad to report that the Cyprus Property Market saw a major collapse during 2009. Fewer than 2,000 properties were sold to international investors and compare this to 2007 when over 10,000 properties were sold, it is a pretty sad picture.</p>
<p>Cyprus has had a lot of negative press during 2009 which has greatly affected overseas sales, plus the value of the sterling had a negative impact also. The Title Deeds issue in Cyprus has scared many of the international buyers away and all these factors together saw to it that Cyprus endured a rough and bumpy journey through this last year.</p>
<p>However, through all this Cyprus still remains to be many overseas investors favourite, as this vibrant country remains in the top ten lists of many worldwide polls to be a safe place to invest for overseas investors. While other countries disappear Cyprus remains consistent within the top ten.</p>
<p>It appears investors are beginning to regain confidence and are looking ahead to the future when Cyprus is free from scrutiny and the economy has inevitably revived.  This is when the investors who had confidence in Cyprus will, with no doubt at all reap the rewards.</p>
<p>Economic policies being implemented will eventually and greatly manifest and the island of Cyprus will thrive once again.   There will be a lot of investors very sad that they missed out on this great opportunity.</p>

<p>Due to a recent review of real estate in Cyprus, it has been suggested that Developers, Agents, Solicitors and other professionals  operating on the Island must edify foreign nationals on all issues concerning Land registration.  With the current market taking a turn for the worse, the developers must also do their duty and put their hand in to play to help pacify this situation.</p>
<p>Professionals must explain in detail to purchasers, how the Land Registration System works regarding Title Deeds for their property.  Also of paramount importance is putting emphasis on the safety of the system and their rights to the property, while Title Deeds are in application. </p>
<p>There has been so much controversy surrounding this issue that overseas buyers have lost confidence in the Cyprus Property market.  We feel this is due to lack of information and we fully support this advisory notion, that developers should play their part in educating purchasers and help in trying to restore their confidence. </p>
<p>Due to the current drop in sales of property, developers are in a vulnerable position, so to speak, as the purchasers are making the most of this situation and demanding more for their money.  There are also many competitive hotspots to choose from around the Mediterranean and in Europe.  Therefore, it is imperative that the developers, agents and solicitors are on top form, and the overseas buyers feel safe investing in Cyprus.</p>

<p>Sales of property in Northern Cyprus, has been a very controversial and risky subject.  As practicing Cyprus Property Lawyers, we take great interest in this subject.  Developers who sell property in the Turkish Controlled Northern Side continue to put their clients at risk.  The reason for this is that, the original Cypriot owners are now taking a stand and making claims for their property that they were forced to leave in 1974 due to the Turkish invasion.</p>
<p>Owners of Property in Northern Cyprus may find that a claim has been brought against their property and the claimant may have the right to take the property back or they can sue the owner for compensation.  Purchasers, who have brought property against any advice given, may find they have made a very foolish and expensive mistake.</p>
<p>It is also advised that previously, the agent has had no duty to find out if there is a claim against the property he is selling.  However, with recent progression in the courts it is now their responsibility to research and declare their findings otherwise the agent can be sued also.</p>
<p>This said UK buyers are no longer interested in property in Northern Cyprus they have grown to aware of the political situation. The Turkish controlled area now relies heavily on the Russian and Israeli investors.  But with the recent court rulings, this may have a big impact on any prospective purchasers thinking of buying in Northern Cyprus.</p>

<p>November 11th, 2009 &#8211; A &amp; G Kouzali Law Office are well established Cyprus Property Lawyers, based in Paralimni. We recently reviewed the efforts of the Committee for the Holy Church of Agia Sophia which is situated in Istanbul, Turkey.</p>
<p>Up until 29<sup>th</sup> May 1453 the Great Holy Church, was a place of worship for its faithful followers. It was the greatest Christian Church ever to be built. But tragedy hit when the Ottoman Turkish soldiers took control of The Great Church in 1453.  Since this date it has been abused and neglected and until recently, it stood as a mosque. However, it now stands as museum for the public and tourists.</p>
<p>It is expected on the 17<sup>th</sup> September 2010, that many members of The International Congregation of Agia Sophia, along with members throughout the world and other political and religious parties, will visit Istanbul and carry out Holy Mass in the Holy Agia Sophia Church. </p>
<p>Mr. Chris Spirou, President of the Congregation of Agia Sophia invited the Turkey Prime Minister Erdogan by letter, to allow all Christians to exercise their Human Rights and attend this &#8216;International Pilgrimage to the Great Agia Sophia Church. </p>
<p>Istanbul has being named, European Culture Capital for the second half of 2010.  To honor that, the Turkish authorities and its Prime minister must at least allow the rest of the European pilgrims to exercise their Human Rights and use that holy temple as it was originally built by Emperors Justinian and Theodora back in the 7<sup>th</sup> century.</p>
<p>The International Congregation of Agia Sophia want to be able to conduct Mass in accordance to their religion, and feel that Prime Minister  Erdogan should make efforts to bring social order to his country.</p>

<p>The office decided to recycle all possible items from scrap paper, bottles, tins, etc.</p>
<p>Specific seminar took place today to brief all colleagues at the office to honor the World Enviromental Day.</p>
<p>At the same time we have sent letters to the municipality of Paralimni giving ideas how to use the existing windmills of the area to provide electrictiy.</p>
<p>Further to that we encourage developers to build ecological houses and the first one will be produced in Sotira – Famagusta.</p>
<p>Finally the Cyprus Property Lawyers department of Kouzalis Law office decided to provide 100 trees to the municipality of Paralimni to be planted in areas needed.</p>
