LAWYERS IN CYPRUS – Study – ECHR decision for the Fokas brothers – completed on 20th February 2010.

In September 2009 the European Court of Human Rights ruled in favour of the Fokas brothers, giving them rights to their late sisters’ properties in Istanbul Turkey along with compensation of loss of use and damages.

The ECHR ruled that Turkey had violated the Fokas brother’s rights and have a time limit to appeal against their decision. However, the Turkish Government have stunned many people by choosing not to appeal.

A Turkish Judge included on the panel making the decision at the ECHR, ruled against his own country. This says it all for the harsh treatment lashed out at the unwanted nationals, forced out of Turkey by Turkish forces.

A friendly agreement must be made between Turkey and the Fokas brothers within a certain time period, otherwise Turkey must pay 24 Million Euros to the brothers.

More than 50,000 residential and commercial properties were left behind in the 1950s and the Turkish Government seized them all.

This historic decision will now be precedent for many thousands of Greek, Jewish and other nationals making claim to their property rights in Turkey.

Cyprus Lawyers – Review- Northern Cyprus Agents – completed by Lawyers in Cyprus on 18th February 2010.

We have studied the Orams v Apostilides case in great length, but little has been said about the agents who have been selling pre 1974 Greek owned property in Turkish Occupied Northern Cyprus.

The European Court of Human Rights and the London Court of Appeals decision is said to help seize all property sales on the northern side and bring a standstill to the Northern Cyprus Property Market. The question now is….. Does this apply to the south also?

Although, the Turkish Cypriot government have other ideas, it appears they believe the ruling will have no impact in the area, as applications have to go through the property commission before it can be implemented.

It would still be very unwise for agents to carry on selling property in the occupied area as they are already skating on thin ice. The current ruling will in no doubt look at the circumstances surrounding any illegal sales and if found in violation, the agent could be liable for some of the financial responsibility if a claim is made.

It seems very likely that at some point in the near future an agent will be brought to court on a property claim. Once this happens, whatever the outcome is , it will stand precedent for all further claims against the agents. This we definitely have to see.

This matter will now proceed for many years to come and hopefully in that time many thousands of Greek nationals will have won back their property rights and justice will be done to those who committed fraud.

At the same time, it opens the doors to our Turkish Cypriot Co-Patriots who will expect to use their properties on the south side, however they see fit.
